These general conditions are concluded between LÁMPARAS SCHULLER S.A. society Madrid Mercantile Register, Volume 6419, General Section 5434 of the 3rd Book of Companies, Folio 153, page 54129, first inscription C.I.F.: ES-A-28763647, Calle Verano 51, 28850 Torrejón de Ardoz, and, people who want to make a purchase through the Internet website of LÁMPARAS SCHULLER SA: www.sulion.es, hereinafter referred to as "customer" . Orders will be dispatched in this country. If the customer resides outside the delivery areas specified above and want a delivery abroad, they can make an inquiry at +34 91 677 45 40 or firstname.lastname@example.org. The parties agree that their relationship is exclusively regulated by this contract. If it came light that a condition was lacking, it would be considered regulated by current distance trading sector customs and practices according to the professional code of conduct of the Association for Distance Trading.
ARTICLE 1 - PURPOSE
The purpose of these general conditions is to define the sales methods including orders, services, payment and delivery, between LÁMPARAS SCHULLER S.A. and the customer. These conditions regulate all the necessary steps to making the order and guarantee that this order is carried out between the contracting parties.
ARTICLE 2 - ORDER
The customer can arrange the order directly from the product listings available on the Website. To make an order the customer must provide certain types of information. Supplying their username and password, if they are already a customer, or completely filling in the blank spaces on the order form without spaces or periods. From the moment the order is placed, the customer fully and completely accepts the prices, the descriptions of the products sold and the general conditions, which are the only ones applicable to such a contract.
ARTICLE 3 - AVAILABILITY
LÁMPARAS SCHULLER S.A. will process the orders of available products. If a product is not available LÁMPARAS SCHULLER S.A. commits to informing the customer as soon as possible.
ARTICLE 4 - PRICES
The sales prices on the Website are given in Euros, with VAT and tax* not included. The prices charged are the ones in effect at the time of order.
*(Royal Decree 110/2015 of the 20th of February in relation to electric and electronic lamps, appliances and light bulbs and the management of their waste (better known as RDRAEE), aims to control the waste being generated by appliances of this type and to guarantee its correct environmental management once its lifespan ends. In order to do so, a tax (canon ECORAEE and ECOATASA) will be levied in order to guarantee the whole process of recycling and environmental management).
ARTICLE 5 - SIGNATURE AND PROOF
A customer that does not have a username and password has to complete a registration process to receive them.
ARTICLE 6 - WARRANTY
In accordance with Royal Legislative Decree 1/2007, all the products sold by LÁMPARAS SCHULLER S.A. are covered by a two-year legal warranty.
This guarantee is not valid in the presence of factors outside its normal usage such as, increases or decreases in voltage, electric discharge, using accessories that are inadequate or prohibited by the manufacturers, falls, water, fire, or incorrect or abusive handling by the client or third parties that are not authorized by the manufacturers, or even materials subject to wear and tear.
ARTICLE 7 - GUARANTEES, AFTER-SALE SERVICES AND COMPLAINT FORMS
As a seller LÁMPARAS SCHULLER S.A. will respond to the buyer about any non-conformity when the items are delivered, in accordance with what is established in Royal Legislative Decree 1/2007 of the 16th of November through which the revised General Law for the Defense of Consumers and Users was passed.
In keeping with article 27.3 of decree 152/2001, from September, through which the Regulation of Law 11/1998, of the 9th of July, for the Protection of Consumers in the Autonomous Community of Madrid, our customers can access complaint forms at the company’s registered office.
ARTICLE 8 - LIABILITY
LÁMPARAS SCHULLER S.A. society excludes any guarantees and any liability for the inconveniences or harm inherent in using the Internet, especially, the breakdown of service or the presence of computer viruses, or any event qualifying as a force majeure in jurisprudence.
ARTICLE 9 - COMPLETE AGREEMENT
These current conditions of Sale constitute the complete agreement between the listed parties. In the event that one of the clauses in of this contract was fully void, because of a change in legislation, in regulations or a court ruling, it would not affect the rest of the articles in this contract.
ARTÍCULO 10 - DURATION OF THESE GENERAL CONDITIONS
These conditions apply for the duration of the online presence of services offered by LÁMPARAS SCHULLER S.A.
ARTICLE 11 - TEST
The computerized records that are held in LÁMPARAS SCHULLER S.A. society and their partners’ computer systems in reasonable security conditions are considered communication tests for the orders and payments produced between the two companies.
ARTICLE 12 - CONSERVATION AND ARCHIVING OF TRANSACTIONS
The archive of orders and invoices is stored in a reliable and durable medium in order for it to correspond to an accurate and durable copy.
ARTICLE 13 - APPLICABLE LAW AND COMPETITION
The conditions are governed according to Spanish legislation. The parties agree to submit any dispute that may arise in the interpretation or execution of these conditions to the courts at the buyer’s residence. In the event that the buyer’s residence is outside Spain, the parties renounce any other jurisdiction and submit themselves to the Courts of Madrid (Spain).
